David vs. Goliath: Lawsuit v. Mikey Weinstein leaps Forward
“A defamation lawsuit filed by a conservative Christian minister and former Navy chaplain against Michael ‘Mikey’ Weinstein and the [Militant Religion Foes Foundation] he founded got a step closer to trial following a hearing Wednesday in Albuquerque,” reports the ABQ Journal.
“District Judge Denise Barela Shepherd dismissed one claim against Weinstein, malicious abuse of process, in the lawsuit filed by Gordon Klingenschmitt of Colorado.
“But she denied Weinstein’s motion to dismiss the defamation claim.

“Klingenschmitt’s lawyers said they believe the case will go to trial.
“Stephen Casey said after Shepherd’s ruling that the claims had been thoroughly investigated before the case was filed and he expects it to go to trial.
“The New Mexico litigation is a spinoff from a Texas case.”
“A Dallas judge ultimately dismissed Weinstein’s lawsuit because he could not prove a causal connection between the former chaplain’s ‘imprecatory prayer’ and a threatened or actual action.
“Klingenschmitt subsequently filed the defamation action against Weinstein and the foundation in state district court in New Mexico because the Weinsteins live in Albuquerque and the foundation is organized under New Mexico law.
“The lawsuit alleges Weinstein made statements on behalf of himself and the foundation in a 2009 radio interview and article in the Dallas Morning News that [falsely] associated Klingenschmitt with acts of vandalismthat occurred at Weinstein’s home…”

The former Navy Chaplain who took a stand to pray “in Jesus’ name” (and was later vindicated by Congress) filed a breaking news defamation lawsuit against the militant anti-Christian activist Mikey Weinstein, who got served yesterday. Chaplain Gordon James Klingenschmitt, PhD, just filed the new legal complaint in New Mexico State Court, citing multiple counts of defamation and malicious abuse of the legal process by Weinstein and his openly anti-Christian organization the Military Religious Freedom Foundation, Inc.

“Unless he believes in time travel, Weinstein knew he was lying about me, and he did so repeatedly,” said the Chaplain. Over 3,000 web-sites have repeated Weinstein’s defamatory words by falsely associating the Chaplain with animal carcasses. This obsession to harm the Chaplain began in 2006, and Weinstein has blogged against the Chaplain about 87 times on his web-site.
In 2009, Weinstein even filed a baseless lawsuit against the Chaplain that was later dismissed for lack of causation by a Texas Judge. “By lying in court about a timeline of causation he knew to be false, we believeWeinstein has maliciously abused the legal process,” said the Chaplain’s attorney Kelly O’Connell. Weinsteinand MRFF have filed and lost up to five baseless lawsuits against the military or against Christian freedom of speech in recent years, legal abuse that may also violate New Mexico law.
