Supreme Court delays stopping Race Quotas at West Point

“The U.S. Supreme Court has rejected a request to prevent the U.S. Military Academy in West Point, New York, from using race as a factor in its admissions policy, even though the high court struck down similar policies at other institutions last year,” reports ChristianPost.
In a miscellaneous order released last Friday, Justice Sonia Sotomayor rejected a request for an injunction pending appeal from the group Students for Fair Admissions against West Point.
“The record before this Court is underdeveloped, and this order should not be construed as expressing any view on the merits of the constitutional question,” noted the brief order.
In June 2023, the SFFA scored a victory when the high court ruled 6-3 in Students for Fair Admissions, Inc. v. President and Fellows of Harvard College that Harvard and the University of North Carolina could not use race as a factor in student admissions.
Last September, SFFA filed a lawsuit against West Point, accusing the military academy of violating the equal protection principle of the Fifth Amendment of the U.S. Constitution.
They also filed a similar lawsuit against the U.S. Naval Academy in Annapolis, MD.
[Dr. Chaps’ comment: Racism is wrong, regardless who’s doing it. Why do Biden’s institutions defend it? It has no place in the military, unless you’re Lloyd Austin or Richard Clark, then they can get away with it.]

3-star favored Race Quotas, defies Supreme Court

The 3-star General Superintendent of the Air Force Academy Richard Clark ’85 sent emails redacted here and here defying a Supreme Court ruling against racial quotas, instead pleading to keep enforcing admissions preference based on skin color.
“As requested, a description of potential impacts to USAFA stemming from the Supreme court ruling on consideration of race in admissions,” Clark wrote. “The court did not apply the decision to service academies in light of the potentially distinct [racial] interests that military academies may present.”
“If USAFA were to voluntarily comply with the Supreme Court decision,” Clark continued, “our ability to shape a [racially] diverse class would become more limited.”
He then admits 10 to 20% of cadets are admitted because of racial factors, despite 80 to 90% of appointments being selected by Congress.
“This leaves 10-20% available to [racially] ‘shape’ across a variety of factors,” Clark wrote. “Examples of the factors include…socioeconomic status, gender, and race/ethnicity.”
And here’s the smoking gun:
“When two candidates are similar in overall qualifications, these [racial] factors are used to design a class of diverse backgrounds in accordance with [Department of the Air Force] DAF’s broad definition of diversity and operational needs.”
“As such, not being able to consider race in a holistic review would further hinder DAF diversity, more so than civilian universities. We do emphasize racial diversity in Prep School selections to increase racial diversity in the cadet wing and Congressional representation…
“In addition, USAFA has historially been the most [racially] diverse rated accession source,” the email concludes.
His words, not mine. As a ’91 AFAcademy grad myself, I emailed Rich Clark ’85 personally, asking for clarification. He did not reply.
[Dr. Chaps’ comment: Since when does the Supreme Court’s reading of the Constitution NOT apply to the military? This 3-star Rich Clark is the SAME man who promised me twice (caught on video here) before 500 eyewitnesses that he’d “absolutely” defend his cadet’s religious freedom, but instead approved 13 letters of reprimand to punish religious cadets who refused the vax mandate, despite all having positive Chaplain letters for their conscience.]
